ENVIRONMENTAL NOISE TESTING
 
In the modern society, sounds are those which cause disturbance. Many sounds are unwanted and unpleasant and as such represent noise that has become an unwanted part of everyday life. In addition to the negative effect of noise disturbance, it can also have a destructing nature, which is reflected in the destruction of material goods and injury to sensitive hearing organs. The most severe cases are when noise damages the mechanism intended for sound perception — the human ear. Measurements of noise levels resulting from the operation of various sound sources (traffic, air conditioners, equipment , etc.) through which sound is created in the environment and indoor living space are performed in accordance with:
  • Law on Noise Protection ("Official Gazette of the Republic of Montenegro", No. 28/11; 28/12; 01/14 and 002/18);
  • Rulebook on limit values ​​of noise in the environment, the manner of determining noise indicators and acoustic zones and methods of assessing the harmful effects of noise ("Official Gazette of the Republic of Montenegro", No. 60/11);
  • Standard MEST ISO 1996-2: 2018 (point 4);
  • Ordinance on technical requirements for sound protection of buildings from noise ("Official Gazette of Montenegro", No. 060/18 of 07.09.2018). ;
  • Regulations on determining acoustic zones (obligation of each Municipality).
The Rulebook on Limit Values ​​of Noise Levels in the Environment, Manner of Determining Noise Indicators and Acoustic Zones and Methods for Assessing the Harmful Effects of Noise (Official Gazette of the Republic of Montenegro No. 60/11) normatively regulates noise levels in populated areas according to settlement zones. outside the building) so that the noise level must not exceed the permissible values ​​for a particular zone.

Each source of undesirable or harmful sound (machine, device, installation, plant, equipment , mean and transport, technological procedure, electroacoustic and acoustic device for loud broadcasting of music and speech, etc.) can be considered a source of noise.

Noise level measurement, depending on the specific case, is performed as follows:

  • fonometar se nalazi na sredini unutrašnjeg prostora (zatvorena vrata i prozori), kada se mjeri buka unutar ugostiteljskog objekta.
  • fonometar se nalazi na udaljenosti ne većoj od 3 m od objekta (terase), kada se mjeri buka oa ugostiteljskih objekta na otvorenom (plažni bar. otvoreni šank i drugi privremeni i pokretni objekti),
  • fonometar se nalazi na sredini sobe/stambenog prostora (zatvorena vrata i prozori), kada se mjeri buka u/iz ugostiteljskih objekata po inicijativi/pritužbi građana, pri čemu mikrofon mjemog fonometra treba da bude na visini 1,5 m od poda/tla.

Noise measurement procedure should be performed several times during the duration of noise in order to determine the average noise level and obtain exact data that are entered in the record.

 

INSTALLATION OF SOUND LIMITERS WITH ENVIRONMENTAL NOISE MEASUREMENT

Pursuant to Article 80 of the Law on Tourism and Catering ("Official Gazette of Montenegro", No. 002/18 of January 10, 2018, 004/18 of January 26, 2018, 013/18 of February 28, 2018) a catering facility in which music is broadcast or on which entertainment program is performed, i.e. uses electro-acoustic and acoustic devices must meet the requirements for noise protection:
  • have sound insulation to ensure that the noise level outside the building does not exceed the prescribed noise limit of 65 dB (A) Laeq;
  • that the use of electro-acoustic and / or acoustic devices does not cause noise inside the building above the noise limit values;
  • that the volume device on which the music is broadcast has a volume limiter installed.
Whether or not conditions of the volume limiter are in accordance with the Law, has be checked by the legal entity accredited for noise measurement and a report on the fulfillment of those requirements should be written.
Limit values ​​of noise levels for all types of catering facilities, the method of measuring noise inside and outside catering facilities, the method of use and conditions that must be met by the volume limiter and volume limiter for mains supply are determined by the Ministry.
 
Ordinance on noise limit values, manner of noise measurement inside and outside catering facilities and manner of use and conditions that must be met by the volume limiter ("Official Gazette of Montenegro", No. 020/19 of 04.04.2019 and 042/19 of July 26, 2019), the limit values ​​of noise levels for all types of catering facilities, the method of measuring noise inside and outside catering facilities, the method of use and the conditions that must be met by the volume limiter are determined by the aforementioned law.

Pursuant to Article 15 of the Law on State Administration (“Official Gazette of the Republic of Montenegro”, No. 78/18), the Ministry of Sustainable Development and Tourism, as the competent state administration body in the field of tourism and catering, has issued Instructions for implementing legal measures and actions for protection against noise in / from catering facilities from electroacoustic and / or acoustic devices.
 
As mentioned before, the noise measurement procedure needs to be performed several times during the duration of the noise in order to determine the average noise level and obtain exact data that are entered in minutes.


The procedure of installation / installation of limiters on devices through which music is broadcast in the catering facility is performed by an authorized repairer / manufacturer / importer of limiters in the presence of representatives of the State Accredited Noise Measurement Person, responsible person of the caterer and authorized communal inspector.
The municipal inspector is obliged to put an official seal on the installed volume limiter, in order to protect against unauthorized opening, removal or damage (the official stamp is stamped on the wax according to the rule of red color at the ends of the guarantor or seal) or a sign (written notice of prohibition), sealing placed on the limiter, official sticker / sealing tape connected by the guarantor) in accordance with Article 4 paragraph 2 of the Ordinance, which completes the procedure of installing the limiter.

The installation of sound limiters in catering facilities in Montenegro has been in place since June 2019.
